This presentation will discuss the various issues that arise when a trustee enters into a self-dealing transaction with the trust. Among other issues, it will address the duty of loyalty, presumption of unfairness, fiduciary compensation, uncompensated benefits, release clauses, consent/release agreements and procedural issues in self-dealing disputes. .
